Abstract

The article analyzes the history and the present state of judicial opinion on academic freedom of the students. The right to academic freedom is reviewed in the context of the First Amendment, in particular the freedom of speech and the freedom of religion. The article analyzes several key court decisions that have formed the doctrine of student academic freedom: Board of Regents of University of Wisconsin System v. Southworth, Brown v. Li, Axson-Flynn v. Johnson, Keeton v. Anderson-Wiley and Ward v. Polite. The University and the faculty can limit student's academic freedom for a legitimate pedagogical purpose. The principle of supremacy of the academic rights of the faculty over those of the students applies when there is a conflict between the academic freedom of a Professor and a student.
