Abstract

The scientific article is devoted to problems of organization the decision compulsory execution system in Ukraine. In the scientific article the classifications of decision compulsory execution systems are viewed, the attention is put on the organization the decision compulsory execution system of some European states, contemporary organization of the decision compulsory execution system of Ukraine is verified. In Ukraine the organization of decision compulsory execution system is represented by the system of government bodies of compulsory execution – state executive bodies, where government executors have posts, who directly execute decisions, and by the system of private subjects of compulsory execution – private executors. During the exploration of the theme of the scientific article it has become possible to state, that it is impossible to execute compulsorily decision from the side of government executor and from the side of private executor at the same time, consequently, at the same time in the system of government bodies of compulsory execution and in the system of private subjects of compulsory execution. In a modern reality the connect of key elements of organization the decision compulsory execution system – the system of government bodies of compulsory execution and the system of private subjects of compulsory execution grounds on that fact, that current legislation doesn’t provide the executive procedure for simultaneous compulsory execution the same decision in the system of government bodies of compulsory execution and in the system of private subjects of compulsory execution the decisions. However, it is possible to transport executive cases / executive documents between the system of government bodies of compulsory execution and the system of private subjects of compulsory execution (the mechanism of transfer of executive documents and executive cases). There are grounds to speak about possibility of informational interaction between private executor and the body of GES as the representatives of the system of private subjects of compulsory execution and the system of government bodies of compulsory execution. Although, this interaction is to be mutual. So it is advisable to spread the circle of subjects, who can give data to executor (subjects of independent professional activities are to be in this circle).
