Abstract

In the scientific article the exploration of intersectional relations between executive law of Ukraine and civil procedural law of Ukraine is done. The differentiation of intersectional relations is grounded on the study by M.Yu Chelyshev about the intersectional relations of civil law (based on exploration of intersectional interaction, intersectional influence, intersectional legal regulation, and intersectional collision regulation). This structure of intersectional relations can be extrapolated to the exploration of intersectional relations of other branches of law. Respectively, in this article intersectional relations between executive law of Ukraine and civil procedural law of Ukraine are explored thought the intersectional interaction, intersectional influence, intersectional legal regulation, and intersectional collision regulation. In the scientific article is stated, that the term of civil case can be used either in a narrow meaning of this word, or in a wide meaning – as a synonym to the term “the case of civil jurisdiction”. Current civil procedural legislation of Ukraine proscribes, that under the process by CPC of Ukraine, the demands that are not private (demands on asset and proprietary rights registration, other registration acts), are considered, however, they are derived from demands on the dispute about asset or proprietary rights (these demands are private) and stated with the private demands. Consequently, in the prescriptions of subpar. 2 par. 1 art. 3 The Law of Ukraine “On executive process” is to be better to use the term “the cases of civil jurisdiction” except of “civil cases”. In the article is proved, that intersectional influence between executive law of Ukraine and civil procedural law of Ukraine is show brightly in legal regulation of the sphere of immediate execution of decisions. Specified above consist in authorization by the prescriptions of CPC of Ukraine the possibility of compulsory execution of some court decisions before they come into force, and establishing by the prescriptions of execution law the specificity of execution of court decisions, mentioned above. In the article is defined that putting into compulsory execution court decisions from the side of court in the cases of civil jurisdiction is really consist of making acts, that are necessary and enough, for having possibility this court decision (or executive document, made under this decision) to be filed for compulsory execution by authorized person (namely, giving / sending to the person, who can realize its’s right to file this decision / executive document to the body (person), authorized for compulsory execution of decisions).
