Abstract

In the scientific article, the consideration of intersectional relations between executive law of Ukraine and family law of Ukraine is done through the prism of their intersectional interaction, intersectional influence, intersectional legal regulation, and intersectional collision regulation. The study of M.Yu Chelyshev on intersectional relations of civil law is taken as the base of this exploration, because the structure of intersectional relations, offered by this scientist, is simple and clear, but in the same time – grounded. In the scientific article on the question of intersectional interaction of executive law of Ukraine and family law of Ukraine there have been offered as follows. For using in the executive law it is advisible to attribute to the circle of members of family physical persons, who comply with at list one of demands, mentioned below: 1) maintaining the marital status (physical persons is a member of family of the person with whom he / she got married); 2) consanguinity (physical persons is a member of family of the persons with the same bloodline); 3) adoption, other forms of taking care of orphans and children who don’t have parents care (adopted person is stated as the member of adopter family, adopter is stated as the member of adopted person family etc.); 4) living together and being obligated by mutual life, existence of mutual rights and obligations (for example, woman / man, that live together, have of mutual rights and obligations, bur are not married, are stated as the members of one family – their family). In the scientific article on the question of intersectional influence of executive law of Ukraine and family law of Ukraine the manifestations of mutual influence of forms of executive law of Ukraine and family law of Ukraine, especially their norms and institutes are explored. The attention is put on the correspondence of the prescriptions of par. 4 art. 190 FC of Ukraine and art. 55 of The Law of Ukraine “On executive process”. In the scientific article on the question of intersectional legal regulation, and intersectional collision regulation of executive law of Ukraine and family law of Ukraine direct and indirect references from the norms of executive law of Ukraine to the norms of family law of Ukraine and vice versa, are explored.
