Abstract
Contractual relations between economic entities are the main regulator of commodity-monetary relations, combining legal, economic, tax and specific aspects of economic activity. It is on the basis of this commercial type of contracts that economic ties arise and are formed not only between subjects of economic relations, but also between other persons, in particular, end consumers of goods or services. However, this, in turn, leads to an increase in the number of contracts, in relation to which there are disputes about recognizing them as invalid. The peculiarity of the legal regulation of invalidity of an economic contract is their regulation by the norms of the Civil and Economic Codes of Ukraine, the provisions of which are based on the different practice of law enforcement of individual grounds for invalidity of an agreement, but contain somewhat different doctrinal approaches that do not take into account the special nature of economic obligations, organizational and property conditions of certain types of business contracts, the specifics of the business activities of the participants in the relationship, and the mechanism for applying the legal consequences of contract invalidity. Such a trend indicates the ambiguity of the interpretation of certain legal provisions in the regulation of contractual relations, which lead to different understandings of economic obligations, making significant mistakes during the conclusion and execution of contracts, which negatively affects the activities of business entities. In order to avoid discrepancies in the provisions of the legislation in law enforcement practice, the scientific study of such legal grounds for invalidity of an economic obligation as fictitiousness and pretense, which includes the analysis of the special nature of economic obligations and their legal grounds of invalidity, becomes relevant
