Abstract
The article examines European institutional law (EIL) as one of the most dynamic legal systems of our time, which includes the legal mechanisms of the European system of human rights protection and the branches and institutions of law for regulating relations that develop in the process of European integration. The stages of the emergence, formation and development of the EIP in its evolutionary progress as a holistic process are analyzed. It is established that the emergence of the EIP, as the first stage, occurred in parallel with the attempt to put into practice the slogan of "European unification" in the period between the First and Second World Wars. The formation of the ENP (the second stage) lasted from the period after World War II until 1989, i.e. until the collapse of the socialist system and the membership of almost all Central and Eastern European countries in the Council of Europe. The new political impetus of the CoE and the creation of the European Union in 1992 led to a stage of development of the ENP that continues to this day. The components of the EIP are considered, which are the law of the Council of Europe (CoE), the law of the Organization for Security and Cooperation in Europe (OSCE), the law of other regional international organizations, and the law of the European Union (EU). The main goals of each of them were, in general, to effectively ensure the resolution of problems related primarily to the restoration and development of the war-destroyed systems of socio-economic life of European peoples. To achieve these goals, the national legal systems of the European member states of the Council of Europe, the OSCE, other regional international organizations, and the EU were set specific tasks in the process of practical unification of Europe, divided by the Second World War. It is determined that the process of development of the EIP has led to the emergence of a special independent supranational legal system ("sui generis"). Unique in its legal structure, the legal system of the EIP generally has no precedents, despite the presence of similarities with other similar structures.
