Abstract

The article examines the legal nature and regulatory architectonics of currency forward contracts, aiming to identify their conceptual features within leading global legal systems and to clarify their position at the intersection of private and public law. The research employs comparative, historical-legal and systemic methods, highlighting the relevance of forward contracts for modern financial markets and offering novel insights into their qualification as “difference contracts” and objects of public regulatory supervision. The study identifies key models of legal regulation in Germany, France and Portugal, emphasizing the role of public-law instruments, such as financial oversight, restrictions on speculative transactions, and doctrines of gaming, wagering and natural obligations. The results may be applied in the fields of financial law, market supervision and legislative reform. The practical value lies in formulating proposals for enhancing Ukrainian legislation on currency forwards in line with European standards. The study concludes that an effective regulatory framework requires a balanced combination of private-law autonomy and robust public-law safeguards to ensure financial stability and investor protection.
