Abstract
The article presents a comprehensive theoretical and legal study of the systemic organization of the institute of the law of money circulation as an inter-branch public-law formation, which occupies a key place within the structure of modern financial law of Ukraine. It is substantiated that the development of the law of money circulation occurs under the influence of the increasing complexity of monetary and credit processes, the digitalization of the economy, the expansion of the regulatory functions of the state, the evolution of financial technologies, and Ukraine’s integration into the European and global financial space. The law of money circulation is defined as a coherent system of public-law norms aimed at ensuring the stability of the national currency, the transparency of financial flows, and the realization of the state’s monetary sovereignty. It is argued that the integrity and functional balance of this institute are ensured through the interaction of basic and auxiliary subinstitutes, which form its structural and functional architecture and reflect the different levels of public-law influence within the monetary sphere. The author introduces an original interpretation of the concept of a “basic subinstitute” as a system-forming element essential for the functioning of the law of money circulation as a coherent legal entity, and a “auxiliary subinstitute” as a legal mechanism that ensures the adaptability of monetary and credit regulation to crisis or exceptional conditions – in particular, during martial law, economic crises, currency instability, or global financial turbulence. The article reveals the subject matter of legal regulation for each key basic subinstitute (the unified state monetary and credit policy, monetary emission, participation of the national payment system, state control and supervision, money circulation in the treasury system, and legal responsibility) as well as for the auxiliary subinstitutes (money circulation under special administrative and legal regimes, within intergovernmental integrations, and the subinstitute of money value formation). It is emphasized that their interaction shapes the internal systemic nature and stabilizing function of the law of money circulation, defining its role in safeguarding financial security, economic sovereignty, and macroeconomic stability of the state.
