Abstract

The conceptualization of the concept of "children with special educational needs" in the Ukrainian legal framework in the field of inclusive education is considered and the results of the study of the adequacy of the use of this the concept of European values ​​and guidelines in the field of education of children with special educational needs. To ensure the reliability of the provisions and conclusions of the study used qualitative content analysis to identify trends in the process of forming the concept of "children with special educational needs" in the Ukrainian legislation poly. Empirical materials were analyzed, which consisted of national policy documents from 2010 to 2019, including Laws of Ukraine, Resolutions of the Cabinet of Ministers of Ukraine, orders of the Ministry of Education and Science of Ukraine. Analysis of the conceptualization of this concept makes it possible to: determine the peculiarities of its understanding in domestic legislative and regulatory documents and inconsistency with the definition given in the Framework Law of Ukraine "On education" (2017); to record a strong enough influence of the medical model on the content of the studied concept, about which shows the understanding of children with special educational needs as children with disabilities and mental and physical disabilities; to conclude that the use of the term "children with special educational needs" in the Ukrainian legal framework is insufficiently consistent with European values ​​and guidelines in the field of education of children with special educational needs; outline the existing positive trends in national education in the context of its compliance with European values ​​and guidelines in the field of education of children with special educational needs needs that demonstrate the movement towards quality inclusive education in Ukraine
