Abstract

The article addresses general theoretical issues of lawmaking, as well as the state of normative regulation and the practical implementation of lawmaking powers by its subjects in this field. In the light of recent events, the necessity of modernizing various spheres of activity within the modern Ukrainian state, including lawmaking, becomes crucial. It should be acknowledged that the issues of lawmaking have always been – and continue to be – the subject of keen attention by scholars, politicians, government officials, business representatives, and citizens. This is due to the need for constant improvement of various forms of state-building, an important component of which is lawmaking. The main goal of modernizing lawmaking is to create conditions for a rapid response to the changes occurring in our country and to anticipate the evolution of the law. Unfortunately, today most of the laws adopted are merely supplements or amendments to previously enacted laws. In view of this, it is evident that we are living in a time when government officials must finally learn to forecast the lifespan of the laws they pass – and do so in advance. We no longer have time for review, improvement, or the implementation of foreign practices; instead, we must solve our problems on our own, clearly and in a timely manner. In other words, if we want to see lawmaking modernization as a process of continual, proactive legislative renewal, it is necessary to actively engage various factors of lawmaking (political-legal, organizational, programming, informational, as well as taking into account the overall state of society) that will allow us to anticipate possible developments in social relations, as well as foresee new and changing needs of society and the state. Our legislative body faces a difficult choice: to implement reforms according to the standards of foreign states or to modernize Ukrainian statehood by adjusting for its distinctiveness and finding its own path. It appears that the answer to this challenging question cannot be unequivocal. The objective political-legal reality indicates an increasing influence of globalization processes in the development of most modern states. However, at the same time, we cannot allow a situation where the priorities of national lawmaking policy are dictated from outside, especially when we have proven to the world that Ukraine is an independent, sovereign country – a country of heroes, and a country that is extraordinarily rich in intelligent and talented people. Speaking about the form and issues related to the implementation of lawmaking, it should be emphasized that lawmaking – as the process of creating and codifying legal norms – occupies one of the central positions in state governance.
