Abstract

The article analyses the transformation of social and labour relations in Ukraine under martial law. It is shown that the war has caused a shortage of personnel, migration processes, and structural shifts in the labour market, while simultaneously requiring the rapid adaptation of legal mechanisms to new conditions. Emphasis is placed on the need to preserve basic social guarantees for employees while at the same time ensuring sufficient flexibility for employers to maintain business viability. Such a balance determines both the scientific and practical significance of the issue under study. The purpose of the article is to analyse the transformation of social and labour relations during martial law, to explore key changes in labour legislation and labour organization practices, and to outline their potential for modernizing labour law and management systems in the post-war period. The methodology combines comparative legal analysis (contrasting regulation in peacetime and wartime), a systemic approach to assessing the interrelation of legal, economic and social factors, the analysis of legal acts, and the synthesis of scientific sources. To systematize challenges and opportunities, the SWOT analysis method was applied and adapted to the specific problem under study. The findings demonstrate that Ukraine’s labour law system during martial law has evolved into a multi-level and dynamic framework, combining the traditional norms of the Labour Code with special wartime legislation and by-laws. Basic social guarantees were not abolished but were significantly adapted to wartime realities. The analysis highlights key innovations such as the introduction of the suspension of employment contracts, the expansion of remote and flexible forms of employment, and compensation mechanisms for employers hiring internally displaced persons. The study revealed the dual nature of these transformations: on the one hand, the preservation of fundamental social guarantees and the strengthening of labour flexibility; on the other hand, the risks of workforce depletion, legal uncertainty, and increased social vulnerability. The prospects for further research lie in assessing the effectiveness of integrating wartime mechanisms into post-war reforms. This primarily concerns the retention of instruments that promote digitalization and labour market flexibility, while abandoning temporary restrictions on labour rights that should remain exceptional to martial law.
