Анотація

The scientific article examines and argues the proportion of the problematic issue's concomitant reflection in the plane of theoretical and scientific argumentation and its mechanism of practical application, which reflects the legal personality of legal entities under martial law depending on the primary legal purpose in the emergency conditions of ensuring the rule of law, European integration processes, and aspects of synergy of the relevant issue with legal regulation in accordance with the analogy in the European partner countries of Ukraine. The purpose of the article is to carry out a scientific study to determine the level of legal regulation of legal personality of legal entities in civil law under martial law in terms of general theoretical regulation within the framework of current legislation, and to conduct a projection study of the relevant issue within the framework of its compliance with the European model of highly developed European countries on the way to establishing fundamental rights and freedoms in the development plane. It is necessary to investigate the essence of legal matter, its tendency to modification and metamorphosis based on a comparative characterization of the legal regulation of legal personality of legal entities in peacetime and martial law by determining the primary restrictions and extensions of the boundaries of regulation sufficient and necessary to ensure the full-fledged activities of legal entities, in the understanding of the potential for the implementation of elements of their activities and powers. The results is determined by the novelty of such a modification of law in Europe within the framework of socio-political life of the aspect of legal personality of legal entities under martial law, which entails a continuous mobilization of the country's legal potential to support the functions of its vital activity in the paradigm of ensuring fundamental rights and freedoms within its administrative-territorial units. The article examines the fundamental elements of legal capacity and legal capacity of legal entities, in particular, the legislative restrictions and incentives for the initiative of the vector of legislative regulation of the State's support in the development of certain areas of activities permitted by law are considered. The basic elements of legal capacity are investigated. Conclusions. Therefore, the civil legal personality of a legal entity within the framework of its legal definition under the primary state regulation in terms of compliance with the challenges associated with the legal regime of martial law is recognised as a full-fledged legal structure which undergoes metamorphosis not in the process of theoretical and applied reasoning and its subsequent implementation in the relevant provisions of current legislation, but as a post-regression to an essential challenge in connection with the urgent need to ensure not only a stable internal political life within the country, but also the need to ensure the possibility of exercising the proper rights and freedoms of legal entities in Ukraine. The issue of defining the legal personality of a legal entity contributes to the proper implementation of all European integration processes in the paradigm of defining the essential and conceptual links between them, thus ensuring the inevitable course of Ukraine's full European integration in the face of constant challenges and military operations.
