Abstract

The article deals with the results of a research of the content of the articles of the Law of Ukraine "On Education" in order to reveal the legal essence of the phenomenon of "educational process", determine the legally regulated organizational features of the educational process at the level of primary education, and establishing the factors of further development of legislative regulation of the educational process in primary school. It has been established that the phenomenon “educational process” has acquired legal certainty since September 1, 2018. In the legally regulated definition of the term “educational process”, both the system of scientific, methodological and pedagogical measures aimed at the development of the individual through the formation and application of his or her competencies, as well as the components of the process (organization, provision, implementation), the coverage of types of education (formal and/or informal education), the functional basis (the activities of the subject of educational activity) and the quality of educational activity become significant. The state educational policy establishes: non-interference in the educational process of political parties and religious organizations; providing freedom in choosing the types, forms, pace of education, educational program, educational institution, and other subjects of educational activity. The following should be included in the legislatively regulated organizational features of the educational process at the level of primary education: 1) certainty of language; 2) variability of forms of primary education and methods of uniting students into classes (groups); 3) organization of the educational process in cycles; 4) ensuring inclusiveness, academic freedom and academic integrity in the educational process; 5) ensuring compliance with the rights and obligations of participants in the educational process in the educational process; 6) implementation of the educational process in a safe and healthy educational environment and using paper and electronic educational literature that meets regulated requirements; 7) comprehensive external and internal verification and assessment of the quality of the educational process. Factors for the further development of legislative regulation of the educational process in primary school are identified in the field of social changes and current events.
