The article deals with the modern economic and legal aspects of the creation and functioning of associations of co-owners of apartment buildings (condominiums) in Ukraine in the current economic conditions. According to statistics on January 1, 2020, 32,982 condominiums were established and operate in Ukraine, excluding data from temporarily occupied territories the number of condominiums is 29,916. The largest number of condominiums was created in 2016 after the adoption in 2015 of the Law of Ukraine “On peculiarities of exercising ownership rights in an apartment building”, which provided a short term of 1 year for independent choice of the form of management in an apartment building. Since 2017, the rate of creation of condominiums on the territory of Ukraine has decreased significantly. Currently, the formation of condominiums is about 140 associations per month. If the rate of creation of condominiums throughout the territory of Ukraine does not increase, then under all circumstances, in all apartment buildings, the associations of co-owners will be create in about 87.5 years. In Kiev, in 2019, the number of condominiums serviced was 11.67% of the total number of dwellings. The highest rates of condominium creation were also observing in 2016. The Kyiv City Council made a low decision to accelerate the formation of condominiums. When creating a condominium, the co-owners face numerous difficulties, which are causing in particular by conflicts of law. Thus, at the stage of initiating the creation of condominiums, the initiative group should determine the total area of all residential and non-residential premises of the house and draw up a list of owners of such premises. The legislation does not contain an exhaustive list of non-residential premises, and the definitions contained in the laws and regulations are not sufficiently clear and lead to different interpretations. In particular, according to the legislation of Ukraine, parking lots are not included in the number of non-residential premises, and therefore the owners of such real estate objects cannot be members of an association of co-owners of an apartment building.
